Middlebrooks v. Lonas

Mary Middlebrooks filed a complaint against her parents, W. L. Lonas and Elvira Lonas, alleging that she loaned them $25,000 in reliance on their promise to repay. The parents used the funds to construct a home on land they already owned. Subsequently, they refused to repay the loan and mortgaged both the land and improvements. Middlebrooks alleged that the defendants’ promises and subsequent actions constituted fraud, creating a constructive trust in her favor. She further alleged that the defendants had pledged and mortgaged the property, making her legal remedies inadequate since any judgment lien would be subordinate to the existing mortgage.
