Michigan v. Clifford
Citation:
464 U.S. 287 (1984)Facts
The Cliffords’ private residence was damaged by fire while they were away on a camping trip. Firefighters extinguished the blaze at 7:04 a.m. and left the premises. Five hours later, at approximately 1:00 p.m., arson investigators arrived to determine the cause of the fire. They found a work crew boarding up the house and pumping water from the basement. The crew had been sent by the Cliffords’ insurance agent at their request. Without obtaining consent or a warrant, the investigators entered the residence and conducted an extensive search. In the basement, they found evidence suggesting arson: two fuel cans and a crock pot with an electrical timer. After determining the fire’s cause, they expanded their search to the upper portions of the house, finding additional evidence. The Cliffords were subsequently charged with arson based on this evidence.
