Commercial Law Keyed to Whaley
Metzger v. Americredit Financial Services, Inc.
Citation:
273 Ga. App. 453, 615 S.E.2d 120 (2005)Facts
Metzger purchased a vehicle financed through Americredit Financial Services. After Metzger defaulted on the loan, Americredit repossessed the vehicle and sent a notice to Metzger regarding the planned disposition of the collateral. Following the sale of the vehicle, Americredit sought a deficiency judgment for the remaining balance of the loan. Metzger contested the deficiency judgment, arguing that the notification was inadequate because it failed to specify whether the disposition would be by public or private sale and did not provide the date, time, and place of a public sale or the date after which a private sale would occur, as required by Georgia law. The trial court granted summary judgment to Americredit, and Metzger appealed.
