In 1986, Congress enacted the Metropolitan Washington Airports Act, transferring operational control of Washington National and Dulles International Airports from the federal government to the Metropolitan Washington Airports Authority (MWAA), a regional authority created by Virginia and the District of Columbia. As a condition of this transfer, Congress required MWAA to establish a Board of Review composed of nine members of Congress who would have veto power over major decisions made by MWAA’s Board of Directors, including airport expansion, new regulations, and budget matters. The Board members were to be selected from lists provided by the Speaker of the House and the President pro tempore of the Senate. Citizens for the Abatement of Aircraft Noise (CAAN), concerned about potential airport expansion and increased noise, challenged the constitutionality of this arrangement, arguing it violated separation of powers principles.
