McInerney v. Charter Golf, Inc
Facts
After Dennis McInerney (plaintiff) was offered a lucrative position by one of his employer's, Charter Golf, Inc. (Sanction) (defendant), contenders, he called Charter's director to tell him he was accepting the offer. Charter’s leader encouraged McInerney to remain with the organization and guaranteed him a similarly lucrative lifetime contract of work. McInerney could only be discharged for dishonesty or disability. McInerney acknowledged Charter's offer. After three years, the connection amongst McInerney and Charter crumbled. Charter terminated McInerney. McInerney at that point documented suit for breach of the agreement. The trial court granted summary judgment to Charter, holding that the oral understanding amongst McInerney and Charter's director was unenforceable under the statute of frauds because an agreement for lifetime employment could not be performed within one year of its making. McInerney appealed. The appellate court affirmed the judgment of the trial court, yet under an alternate hypothesis. The appellate court noted that no lifetime employment contract between McInerney and Charter existed because a guarantee to forgo another opportunity for work was an insufficient consideration to enforce a lifetime employment contract. The Illinois Supreme Court granted certiorari to review.
