George R. McGurn (Plaintiff) received a signed employment offer letter from Bell Microproducts, Inc. (Defendant). The letter stipulated that if plaintiff was terminated without cause during the first 12 months of his employment, he would receive a severance package of $120,000. When countersigning the offer, plaintiff crossed out “12” and replaced it with “24.” Plaintiff did not otherwise inform defendant of this change. 13 months later, defendant filed plaintiff.
