Facts
Lowell Franklin, Plaintiff’s son and a California resident, purchased a life insurance policy with an Arizona corporation that was bought out by Defendant company. Defendant company mailed a reinsurance certificate to Lowell, who accepted the offer to be insured by Defendant and mailed premiums from his California home to Defendant’s Texas office until his death. At his death, Lowell’s mother (Plaintiff) tried to receive the life insurance payment but the company refused to pay claiming that Lowell had committed suicide.
Defendant company had no offices or agents in California, and there was no evidence that they solicited or did any insurance business in California outside of this one policy for Lowell Franklin.
