McClandon v. Dakem & Associates, LLC

Dakem & Associates obtained a judgment against Joeann McClandon in Nevada in 2005 and domesticated it in Florida in 2008. McClandon held controlling interests in eleven limited liability companies. To collect on the judgment, Dakem initiated proceedings supplementary and sought a charging order against McClandon’s interests in these LLCs. The trial court granted the charging order and appointed a receiver to take control of four of the LLCs’ finances. The receiver was authorized to act as the de facto Chief Financial Officer and make financial management decisions for these LLCs. McClandon appealed, arguing that Florida Statute § 605.0503 only permits a charging order as the exclusive remedy and does not authorize appointment of a receiver with managerial powers.
