Problems in Legal Ethics Keyed to Schwartz, 14th Ed.
Matter of Giuliani
Citation:
146 N.Y.S.3d 266, Motion No. 2021-00491 (2021)Facts
Following the 2020 presidential election, Rudolph Giuliani, acting as attorney for Donald Trump and the Trump campaign, made numerous false statements in various forums including court proceedings, legislative hearings, and media appearances. These statements included false claims about Pennsylvania mail-in ballots, deceased voters in Philadelphia, Georgia election results, underage voters in Georgia, felons voting in Georgia, and illegal counting of ballots in Arizona. The Attorney Grievance Committee investigated complaints about Giuliani’s conduct and moved for his interim suspension, arguing that his false statements were made to bolster a narrative that the 2020 election was stolen from his client. The AGC contended that these statements, made with the authority of being an attorney and using his significant public platform, threatened the public interest by undermining confidence in elections and democratic institutions.
