Martens Chevrolet (Plaintiff) purchased a car dealership from Seney (Defendant) based on Seney’s representation that the car dealership was financially solvent, but later found out that the dealership was not financially sound and that Seney had made false statements about audited financial statements concerning the dealership. Plaintiff sued Defendant for negligent misrepresentation, alleging that Plaintiff entered into contract to a purchase car dealership from Defendants based on Defendants’ false statements as to the financial condition of the dealership. The trial court entered a verdict for Defendant.
