Jack R. Lehman was hired by Pacific Gas and Electric Company on June 15, 1959, and married Marietta Lehman on June 11, 1960. He began participating in PG&E’s defined benefit retirement plan on May 1, 1962, accruing retirement benefits during the marriage. The couple separated on October 29, 1977, and obtained dissolution on February 23, 1979. In March 1993, PG&E offered a Voluntary Retirement Incentive program to avoid employee discharges, providing enhanced benefits through three putative years of service credit and waiving the normal eighteen percent early retirement actuarial reduction. Husband, meeting eligibility requirements, elected to retire early at approximately 54.33 years of age under the VRI program effective January 1, 1995, receiving enhanced monthly retirement benefits of $3,059.30, which was $708.91 more per month than he would have received retiring early at age 55 without the enhancement.
