Maples v. Thomas

Maples (Petitioner) was convicted of capital murder in Alabama. Two New York attorneys represented him in post-conviction proceedings, in which Maples asserted that his court-appointed attorneys provided constitutionally ineffective assistance during his capital trial; the court ruled against Maples. Before he could appeal this judgment, the New York attorneys at the law firm who had been representing him pro bono departed the firm without finding replacement counsel, and the window to file an appeal expired. Neither attorney told Maples of their departure or of their resulting inability to continue to represent him, nor sought leave to withdraw from the trial court, which violated Alabama law. Maples sought habeas corpus relief in federal district court in Alabama, asking to file an untimely appeal.
