George Malonis (Plaintiff) represented a client in a personal injury action. Partway through the litigation, the client discharged Malonis and retained a different lawyer, Robert Harrington (Defendant), under a contingency fee agreement. After a settlement was reached in the personal injury litigation, the client did not pay Malonis for his prior services, assuming that his obligations were covered by the contingency fee. Malonis then filed a claim against Harrington for attorney’s fees for the legal services performed and expenses incurred during the time he represented the client.
