California Civil Procedure, Keyed to Levine, 6th Ed.
Maldonado v. Superior Court
Citation:
94 Cal. App. 4th 1390, 115 Cal. Rptr. 2d 137 (2002)Facts
Petitioners Oscar Maldonado, J. Miguel Ibarra, Gustavo C. Gomez, and Faustino Boria brought an employment discrimination lawsuit against their former employer ICG Telecom Group, Inc., alleging their terminations or coerced resignations resulted from a racially-based policy called “footprinting” that segregated Los Angeles into regions where sales and services would or would not be provided. Petitioners served three deposition notices seeking to depose the persons most knowledgeable about the reasons for terminations, supporting documents, ICG’s interrogatory responses, and the company’s sales and service areas. ICG, which had undergone financial difficulties and bankruptcy resulting in layoffs of supervisors and human resources personnel, designated Patricia M. Haley as the person most knowledgeable concerning employment matters and Karen Sparrow and Robert Athey concerning footprint issues. However, these witnesses demonstrated very little actual knowledge about the specified topics, failed to bring requested documents, could not identify personnel files, and provided inadequate responses to questions about employment policies and the footprinting policy.
