The plaintiffs alleged that Trump University made material misrepresentations in advertisements and promotional materials to induce prospective customers to purchase real estate investing programs. Specifically, defendants allegedly falsely represented that Trump University was an accredited university, that students would be taught by real estate experts hand-selected by Donald Trump, and that students would receive one year of expert mentoring. Named plaintiffs paid between $1,495 for three-day seminars and $35,000 for elite programs. The court had previously certified five subclasses covering purchasers in California, New York, and Florida under various consumer protection statutes. Defendants sought decertification arguing that plaintiffs’ full-refund damages model was inconsistent with their liability theory under Comcast v. Behrend because it failed to account for any value students received from the programs.
