Facts
The Huttons conveyed a warranty deed to the predecessors of the County Board of Trustees of Lawrence County (the defendants). The deed stated that “this land to be used for school purpose only; otherwise to revert to Grantors herein.” The land was used as a school until May 30, 1973, and after that, it was only used for storage. The Huttons later transferred their claimed reversionary interest from the deed to the Mahrenholzes’ (the plaintiffs’) predecessor, who then transferred it to the plaintiffs. In May 1977, the sole heir of the Huttons also transferred all of his interest in the property to the plaintiffs. In September 1977, the sole heir of the Huttons disclaimed and released his possibility of reverter or right of entry to the defendants in a document entitled “Disclaimer and Release.”
