M.P.M. Builders owned a parcel of land, upon which ran a private cartway to the public road. Dwyer purchased a neighboring property, and included in the conveyance for the property was an easement to use this cartway. The cartway had three entry/exit points for Dwyer to access their property. M.P.M. Builders sought to develop their property, and to facilitate this development M.P.M. Builders planned to adjust the size and location of these access points on Dwyer’s property to the cartway. Dwyer’s conveyance did not expressly prohibit such adjustments to the easement. Dwyer sued.
