The plaintiff suffered a heart attack while a patron at the defendant’s casino, TropWorld. While the plaintiff was gambling at a blackjack table, he suffered cardiac arrest and fell to the ground unconscious. The blackjack dealer at the table pushed the emergency “call” button at his table and a nurse who was on-duty at the casino medical station arrived on the scene. As soon as the nurse arrived, she instructed security to call for an ambulance. The nurse brought an ambu-bag, oxygen, and an airway. However, she did not bring an intubation kit to the scene. Equipment normally found in an intubation kit was stocked in TropWorld’s medical center, but she did not bring this equipment with her because she was not qualified to use it. Upon arrival of the EMT unit, a technician, with the help of tow doctor patrons, attempted to intubate the plaintiff using an intubation kit brought by the EMT unit. After intubation, the plaintiff regained a pulse.
