Robert Lundquist, a Massachusetts resident, rented a Cessna aircraft from Precision Valley Aviation (PVA) at their facility in Springfield, Vermont. PVA is a Vermont corporation that provides aircraft rental, maintenance, and repair services. Lundquist was piloting the rented aircraft when it crashed in New Hampshire, allegedly due to PVA’s negligent maintenance. Although PVA had no physical presence in Massachusetts, it had previously rented aircraft to Massachusetts residents, and approximately 10-15% of its business came from Massachusetts residents. PVA also advertised in publications that circulated in Massachusetts and maintained a toll-free telephone number accessible to Massachusetts residents. Lundquist filed suit in the United States District Court for the District of Massachusetts, asserting claims for negligence.
