Lucas v. South Carolina Coastal Council

In 1986, Lucas purchased two lots on the Isle of Palms in South Carolina for over $1 million with the intention of building single-family homes on each, as had the owners of the immediately adjacent lots. In 1988, before Lucas began construction, the South Carolina legislature enacted the Beachfront Management Act, which prevented construction on land within a certain distance of the coastline, in order to stem beach erosion. The law did not require existing homes to be removed. Lucas’s property fell within this restricted area. The state paid him nothing for the deprivation of the use of his land. He brought suit claiming that the regulation effected a taking without just compensation.
