In 1977, the City of Los Angeles conducted a study that found a correlation between concentrations of adult businesses and higher crime rates in surrounding areas. Based on this study, the city enacted an ordinance in 1978 requiring adult businesses to be dispersed. In 1983, the city amended the ordinance to prohibit more than one adult entertainment business in the same building, closing a loophole that allowed multiple adult businesses to concentrate in a single structure. Alameda Books and Highland Books each operated both an adult bookstore (selling adult materials) and an adult video arcade (providing viewing booths for videos) in the same building. After a city building inspector found Alameda Books in violation of the ordinance in 1995, both businesses sued under 42 U.S.C. § 1983, alleging that the ordinance violated the First Amendment. The city argued that its prohibition on multiple-use adult establishments served its interest in reducing crime, relying on its 1977 study.
