Trevor Loose, an Australian citizen employed by Offshore Navigation as a mobile electronics operator, was injured when he fell off a gangplank while disembarking from the Deep Sea Explorer. Offshore Navigation provided electronic navigational services for underwater seismic operations. The vessel was owned by Guzzetta Offshore Marine Service, bareboat chartered to Petty Ray Geophysical, and crewed by Midnight Boat Corporation. The aluminum gangplank from which Loose fell was allegedly owned by Petty Ray. Loose sued his employer under the Jones Act and the other parties for negligence under general maritime law and unseaworthiness. The jury found Petty Ray 50% at fault (actively negligent), Midnight Boat 25% at fault (passively negligent), and vessel unseaworthiness responsible for 25% of the injuries, awarding Loose $61,500 in damages.
