Lightning Litho v. Danka Industries
Citation:
776 N.E.2d 1238 (2002)Facts
Thomas Haab owned Lightning Litho, a small printing company in South Bend, Indiana. During summer and fall 1996, Danka salesperson Scott Linn repeatedly approached Haab about leasing a high-volume copier capable of producing 500,000 to 1,000,000 copies monthly, despite Litho only needing 5,000 to 20,000 copies monthly. Linn eventually promised Haab a guaranteed account that would generate six million copies and $50,000 profit annually, stating “the account is in my back pocket, it goes with the machine.” Danka manager John Leiter confirmed this representation but refused to put it in writing. Relying on these promises, Haab signed a sixty-month lease at $755 monthly on November 14, 1996. The promised account at Commercial Driver’s Institute never materialized, and Litho made payments for nearly two years before defaulting.
