Lewis (plaintiff), a sawmill operator, converted the power equipment used to run his sawmill to hydraulic equipment. The plaintiff consulted with a local oil dealer for Mobil Oil Corporation (defendant) about what type of hydraulic oil he needed for the equipment. The dealer sold the plaintiff Mobil’s Ambrex 810, based on the minimal information provided by the plaintiff and requested by the dealer. The plaintiff had trouble with his equipment for the next two and a half years, and although he changed pumps he continued to use the same oil based on the defendant’s recommendation. Finally, when he switched to a new oil, his equipment worked properly. The plaintiff sued the defendant for breach of implied warranty of fitness, arguing that the breakdowns were caused by the improper oil and resulted in lost profits for the plaintiff.
