The plaintiffs were passengers in a 1976 Jeep CJ-7 manufactured by American Motors Corporation when the vehicle pitched over during off-road recreational use. The Jeep was equipped with a roll bar that the manufacturer advertised as providing “added protection” and described as “rugged, reinforced steel” for safety. When the pitch-over occurred, the roll bar’s support structure, which was attached to thin sheet metal, failed to adequately protect the occupants. The plaintiffs sustained serious spinal injuries that they alleged were enhanced by the inadequate design of the roll bar system. American Motors had advertised the vehicle for off-road use with commercials depicting the Jeep traversing steep and rugged terrain, but had conducted no testing of the roll bar system for pitch-over accidents on the CJ-7 model.
