In June 1989, Deborah Weisman graduated from Nathan Bishop Middle School in Providence, Rhode Island. Following school district policy, Principal Robert E. Lee invited Rabbi Leslie Gutterman to deliver prayers at the graduation ceremony. Lee provided the rabbi with a pamphlet titled “Guidelines for Civic Occasions” and advised him to keep the prayers nonsectarian. Daniel Weisman, Deborah’s father, objected to the inclusion of prayers at the ceremony but was unsuccessful in preventing them. During the ceremony, students stood for the Pledge of Allegiance and remained standing for the rabbi’s invocation and benediction. The District Court found that the practice violated the Establishment Clause, and the Court of Appeals affirmed. The school district argued that attendance at graduation was voluntary and that the prayers were nonsectarian, thus not establishing any particular religion.
