Criminal Law Keyed to Gershowitz
Lee v. State
Citation:
59 Md.App. 28, 474 A.2d 537.Facts
An employee of a pharmacy-liquor store observed the defendant concealing a bottle of liquor in his pants and another in his hand. When approached by the employee, the defendant returned both bottles to the shelf and fled the store. He was chased by the employee who flagged down a passing police cruiser. Subsequently, the defendant was arrested and convicted of two counts of theft. He appealed, arguing that the evidence was not sufficient to convict him since he abandoned the liquor and departed from the premises.
