Lee v. Butcher Boy
Citation:
215 Cal. Rptr. 195 (1985)Facts
Plaintiffs Yong and In Hak Lee purchased a market in Downey, California, which included a meat grinding machine manufactured by Butcher Boy and Lasar Manufacturing Company. The machine incorporated a standard electric motor manufactured by the defendant Electric Motor Division. On January 15, 1979, Yong Lee was injured while using the machine to grind meat when her right hand was caught and crushed in the grinding mechanism, resulting in amputation of her hand and part of her forearm. Plaintiffs filed suit alleging that the motor was defectively designed because it did not stop immediately when turned off, which they claimed caused more severe injuries. The evidence showed that the motor was a standard “off-the-shelf” item purchased by Lasar, who had been designing and manufacturing such machines since 1922. William Lasar testified that he did not seek advice from the defendant about motor selection but told them exactly what he wanted. All motors, even “brake motors,” take several seconds to stop after being turned off.
