In Houston, Texas, police officers were dispatched to a private residence in response to a reported weapons disturbance. They entered an apartment where one of the petitioners, John Geddes Lawrence, resided and observed him and another man, Tyron Garner, engaging in a sexual act. Lawrence and Garner were arrested, held in custody overnight, and charged and convicted under Tex. Penal Code Ann. Section 21.06(a) for engaging in deviate sexual intercourse with another individual of the same sex.
