Mary Sheldon Lyon died in October 1946 with a will executed in 1943 that left substantially her entire estate to Father Divine, his religious organizations, and follower Patience Budd. After executing this will, Lyon repeatedly expressed her desire and determination to revoke it and execute a new will benefiting the plaintiffs with substantial legacies totaling approximately $350,000. She had attorneys draft this new will naming plaintiffs as legatees. However, defendants allegedly used false representations, undue influence, and physical force to prevent Lyon from executing the new will. Shortly before her death, Lyon again expressed determination to execute the proposed will, whereupon defendants allegedly conspired to kill her and did kill her through a surgical operation performed without consent or knowledge of her relatives. The 1943 will was probated under a compromise agreement with distributees.
