Lanes v. State

The appellant, John Kenneth Lanes, was a juvenile who was certified to stand trial as an adult for burglary of a habitation. Pursuant to a consent order from the juvenile court authorizing the taking of Lanes’ fingerprints under Section 51.15 of the Texas Family Code, a police officer arrested Lanes at his high school, transported him to the police station, and took his fingerprints. These fingerprints were the only direct evidence linking Lanes to the crime scene. The trial court and Court of Appeals found that the fingerprint order provided sufficient authority for the arrest. Lanes was subsequently convicted of burglary and sentenced to twenty years imprisonment. The Texas Court of Criminal Appeals granted review to determine whether the probable cause requirement applies to juvenile arrests.
