Contracts Keyed to Fuller
Lane v. Kindercare Learning Centers, Inc.
Citation:
231 Mich.App. 689, 588 N.W.2d 715 (1998)Facts
On December 9, 1992, plaintiff Lane dropped off her eighteen-month-old daughter at Kindercare’s daycare facility around lunchtime, completing a medication authorization form for the child. At approximately 6:00 PM, Kindercare employees locked the facility and left, unaware that the child was still sleeping in a crib. When Lane arrived to pick up her daughter, she found the facility locked and dark. After calling 911, police officers located the child through a window and had to break into the building to retrieve her. The child was upset but not physically harmed. Lane alleged she suffered emotional distress from the incident and filed suit against Kindercare, claiming breach of contract, statutory violations, negligence, and gross negligence. Lane also discovered that the medication authorization form had not been initialed, suggesting the medication had not been administered.
