Laidlaw v. Organ
Citation:
15 U.S. 178 (1817)Facts
On February 18, 1815, Hector M. Organ negotiated with Francis Girault of Peter Laidlaw & Co. for the purchase of 111 hogsheads of tobacco. That night, news arrived via the British fleet that the Treaty of Ghent had been signed, ending the War of 1812. This information was communicated to Organ early on February 19 by the brother of one of the messengers who had a financial interest in Organ’s purchase. Before the news became public, Organ visited Girault “soon after sunrise” to complete the purchase. When Girault asked if there was any news that might enhance the value of tobacco, Organ remained silent. The purchase was completed between 8 and 9 a.m., and shortly thereafter the news became public through a handbill. As a result, tobacco prices rose 30-50%. When Laidlaw discovered the news, they refused to deliver the tobacco, leading Organ to file suit for possession.
