Kuder v. Schroeder
Citation:
110 N.C. App. 355, 430 S.E.2d 271 (1993)Facts
Plaintiff Cynthia Kuder and defendant Thomas Schroeder married in March 1978 and had one child in June 1984. After marriage, they entered an oral agreement whereby plaintiff would forego her veterinary career and work as a community college teacher to provide sole financial support while defendant pursued undergraduate education at the University of North Carolina at Chapel Hill. Defendant agreed that upon completing his studies, he would provide total family support so plaintiff could become a full-time wife and mother. The parties subsequently extended this agreement to allow defendant to pursue a Master’s degree and then a law degree. Plaintiff continued working and providing sole support throughout this period. After law school graduation, defendant started a legal research business that initially failed to generate sufficient income. In December 1989, defendant obtained a law firm position earning approximately $38,000 annually, finally able to support the family. However, three months later in April 1990, defendant told plaintiff he no longer loved her and wanted to end the marriage, and the parties separated. Plaintiff sued for breach of contract and unjust enrichment.
