The plaintiff was an artist who created plexiglass sculptures. One day he entered his studio to find a station wagon parked within. The car had been placed there by defendant Bronson so that he could avoid the chill of the morning while endeavoring to fix some dents in the automobile. The plaintiff would later give the defendant a dent-removing tool and asked him to remove the vehicle as soon as possible. The plaintiff then turned away to use his phone. While still on the phone, the plaintiff glanced back and saw the defendant fly through the air and land in the middle of a plexiglass sculpture. A total of for sculptures were destroyed.
