Kramer v. Thompson
Citation:
947 F.2d 666 (1991)Facts
Steven Kramer represented Richard Thompson in a securities fraud action from 1982 to 1985. Their relationship deteriorated when Thompson learned that Kramer had informed an FBI agent that Thompson’s stocks, while substantially depreciated, were not completely worthless. Thompson discharged Kramer and refused to return case files without agreeing to escrow any future settlement proceeds. Beginning in February 1986, Thompson wrote approximately 160 letters to 60 different recipients including judges, prosecutors, newspapers, and television stations falsely accusing Kramer of professional misconduct, involvement in a “Yuppie Drug Ring,” connections to organized crime, and committing arson on his own vehicle. After Kramer filed suit, a jury awarded him $138,000 in damages, and the district court issued a permanent injunction prohibiting Thompson from making further defamatory statements and ordering him to retract past statements.
