Young, an employee of Spokane, was told to look into buying a surge protector by his employer. Young did some research and found that devices ranged from $50 to $200. Young reached out to Konic about their surge protector. When Young asked about the price, the salesman said, “fifty-six twenty,” meaning $5,620, but Young thought he meant $56.20. Young prepared a purchase order for $56.20 and had it appropriately approved. Young made the order. Konic shipped the product and Spokane installed it. The discrepancy between the prices was not immediately realized. Spokane’s president was not present when this installation was done. When the president returned, he immediately realized that the product was worth more than the $56 and ordered that the power to it be shut off. The president told Young to verify the price of the product, but Young did not. Spokane processed the invoice two weeks later and then discovered the discrepancy in price. The president of Spokane told Konic they did not want the equipment and that Konic should remove it. Konic refused and demanded that Spokane pay the $5,620. When Spokane refused, Konic brought this claim.
