The plaintiff, Knitz, was injured while operating a power press manufactured by Minster Machine Co. The press was equipped with a foot pedal activation system but lacked adequate guarding at the point of operation. According to the plaintiff’s testimony, the accident occurred when she was attempting to pull the foot switch toward her but not intentionally trying to activate it. The press unexpectedly activated, causing the ram to descend on her hands. The press was equipped with hold-back guards, but Knitz was not using them at the time of the accident. The plaintiff presented expert testimony that the press was defectively designed due to inadequate guarding at the point of operation and inadequate protection against accidental activation of the foot pedal.
