Dorothy Lyons worked for Kerr-McGee as a “switcher” in the Breton Sound Gas Field off the Louisiana coast, conducting tests at offshore well sites to ensure proper oil and gas flow. Kerr-McGee time-chartered vessels, including the C.C. RIDER owned by Ma-Ju Marine Services, to transport workers between platforms and well sites. On July 4, 1982, while descending steps from the cabin deck to the main deck of the C.C. RIDER, Lyons fell when the boat lurched, causing significant injuries. Lyons claimed her injuries resulted from negligence in failing to use nonskid paint on the steps, failing to provide adequate handrails, having steps that were too steep, and a piloting error that caused the vessel to lurch. Lyons lived on fixed platforms during her seven-days-on/seven-days-off work schedule, and her duties were performed at fixed well sites. The vessels merely transported her between work locations, and she performed no substantial vessel-related duties.
