Kennedy v. Dabbiere

Kennedy was employed by Dabbiere’s technology company for approximately five years, during which time he had access to confidential information and trade secrets. As a condition of his employment, Kennedy signed a non-compete agreement that prohibited him from working for any competitor for a period of two years following the termination of his employment, with no geographic limitation. The agreement also contained a provision preventing Kennedy from soliciting the company’s clients or employees. After Kennedy resigned from his position, he sought employment with a competing firm but was concerned about potential legal action from Dabbiere based on the non-compete agreement. Kennedy filed suit seeking a declaration that the agreement was unenforceable.
