Facts
In 2000, the City of New London, Connecticut, approved a comprehensive development plan for the Fort Trumbull area to capitalize on Pfizer’s decision to build a $300 million research facility nearby. The city, which had been designated a “distressed municipality” by the state, hoped the plan would create over 1,000 jobs, increase tax revenue, and revitalize the economically struggling city. The New London Development Corporation (NLDC), a private nonprofit entity, was designated to implement the plan. The development encompassed 90 acres divided into seven parcels for various uses including a waterfront conference hotel, residential units, research and office space, retail establishments, marinas, and a riverwalk. When negotiations to purchase some properties failed, the NLDC initiated condemnation proceedings. The petitioners, nine property owners of 15 homes in the development area, sued, claiming the takings violated the “public use” requirement of the Fifth Amendment since their properties were not blighted and would be transferred to private developers.
