Brian Keith (plaintiff) belonged to a yacht club, had attended sailing school, and had sailed on many yachts. He finally decided to purchase a yacht from Buchanan (defendant) for a total purchase price of $75,610. The yacht, called the Island Trader 41, was advertised as a seaworthy vessel. Keith relied on these representations when making his purchase. He also asked a friend to inspect the yacht and Keith was advised that the boat would suit his needs. A dispute later arose regarding the seaworthiness of the yacht. Keith brought suit against Buchanan for breach of express and implied warranties.
