Karl Bjorkman, Appellant, vs. Arctic Cat
Citation:
2011 WL 5119129 (2011)Facts
Karl Bjorkman began working for Arctic Cat in 1991 and became an international sales manager in 1998. In May 2007, Arctic Cat announced plans to relocate many managerial positions to Plymouth. In July 2008, Bjorkman met with Arctic Cat’s CEO and VP of human resources, who offered him three options: relocate to Plymouth with a salary increase, seek a different position at the Thief River Falls facility, or resign and receive a severance package of one week’s pay for each year of service. This offer was put in writing with a requested response by August 8, 2008. Bjorkman responded by asking for a higher salary but did not accept any option. After several exchanges, in January 2009, the CEO gave Bjorkman only two options: move to Plymouth with a $90,000 salary or stay in Thief River Falls in his current position with a retroactive raise. The severance option was not mentioned. Bjorkman resigned on January 12, 2009, stating he would take the severance package, but Arctic Cat informed him that option was no longer available.
