The Plaintiff, nine-year-old Steven Kane, was playing on playground equipment designed by the Defendant. The equipment, known as the “Infant Maze” was intended for children between approximately eighteen months and three years. The features of the equipment included several vertical panels, cutouts of various shapes, and sizes, and a pitched roof that older children often climbed on top of. Even though the Plaintiff knew that the structure was not made for children of his age, he tried to climb to its roof like the other older children. While climbing, he fell sustaining serious injuries. The Plaintiff on appeal claimed that he did not have actual knowledge of, or appreciated the danger of falling from the structure.
