After an Amtrak train collided with a tractor operated by an employee for Clark Gin (Defendant), several individuals on the train, included Johnson (Plaintiff) filed a lawsuit against Clark Gin. Clark Gin filed a motion to disqualify plaintiffs’ counsel based on a conflict of interest. Counsel represented multiple plaintiffs, including several Amtrak service employees and a passengers. The defendants argued that there was a significant risk the representation of one or more clients will be materially limited by counsel’s responsibilities to the other plaintiffs.
