The Defendant (Pepsico) ran an ad promoting the Pepsi Stuff campaign, which allows consumers to redeem Pepsi Points earned through drinking Pepsi for merchandise. The ad shows a teenager instantly cashing in points for several items on the way to school and culminates in him arriving at school in a Harrier military jet, which the commercial showed with a price of 7,000,000 Pepsi Points. The Pepsi Stuff campaign includes a catalog, which lists the various merchandise for sale and includes the Pepsi Point prices. The prices range from 15 (for a “jacket tattoo”) to 3300 (for a “Fila Mountain Bike”). There is no Harrier jet in the catalog. The Plaintiff (Leonard) tries to purchase a Harrier jet anyway. He collects $700,008.50, enough money to directly purchase 7,000,000 Pepsi Points, and sends an order form for the Harrier jet. The Defendant denies that the Harrier is available, citing the Catalog to show that it is not listed for sale, and states that the commercial was clearly made for humor and entertainment, and that no reasonable person would believe that it was an offer.
