On December 21, 1998, John Garrett, an African-American man, entered a Radio Shack store in Brunswick, Maine, to purchase a police scanner. Throughout his visit, he was closely monitored by three white employees. After being told the scanner was out of stock, Garrett purchased a book, telephone, and batteries. The store manager, Steven Richard, took Garrett’s name and address during the transaction. Shortly after Garrett left, Richard discovered a laptop computer worth approximately $2,000 was missing. Richard reported the theft to Brunswick police, identified only Garrett as a suspect, and provided his address, despite other white customers having been in the store at the same time. Police visited Garrett’s home in Bath to investigate, searched his home and car with permission, but found nothing. When Garrett called Radio Shack to complain about what he perceived as racial discrimination, Richard falsely claimed that all customers present during that time frame had been reported as suspects. Garrett became dissatisfied with his purchases but feared returning them would lead to more accusations.
