Janvrin v. Continental Resources, Inc.

Jerry Janvrin operated J&J Trucking, which hauled materials primarily for CTAP, an equipment supplier serving the oil industry. Continental Resources was CTAP’s largest customer in the Bakken region. In February 2014, a Continental truck struck and killed two cows belonging to Janvrin’s relatives during a blizzard. Janvrin expressed concern to a local newspaper about drivers speeding on rural roads. Gordon Carlson, Continental’s district supervisor, took offense at these comments and contacted his superiors to request that Janvrin no longer deliver to Continental’s sites. This led to Ollis Anderson, Continental’s Director of Supply Chain Management, calling Michael McCarrell, CTAP’s Senior Vice-President of Operations. Shortly after this call, McCarrell instructed Ron Spidahl, CTAP’s supervisor at the Bowman terminal, to remove Janvrin from CTAP’s lineup entirely. When Janvrin inquired about his termination, both companies ignored his requests for information. Evidence suggested that Carlson later bragged about shutting down a trucking company.
