Jacque v. Steenberg Homes, Inc.

The Jacques owned approximately 170 acres of land in Schleswig, Wisconsin. In February 1994, Steenberg Homes needed to deliver a mobile home to a neighbor of the Jacques. The easiest delivery route was across the Jacques’ property. Steenberg asked for permission multiple times, but the Jacques adamantly refused, partly due to having previously lost property in an adverse possession action. Despite these refusals, Steenberg’s assistant manager instructed employees to “get the home in there any way you can.” The employees used a “bobcat” to cut a path through the Jacques’ snow-covered field and delivered the mobile home across their land. When the Jacques discovered the trespass, they called the sheriff, who issued a $30 citation to Steenberg’s assistant manager. The Jacques then sued for intentional trespass, seeking compensatory and punitive damages.
