On behalf of T.B., the mother of a minor child, the State of Alabama filed a paternity and child support complaint against J.E.B. in Jackson County District Court. During jury selection from a panel of 36 potential jurors (12 males and 24 females), after three jurors were excused for cause leaving 10 males among 33 remaining jurors, the State used 9 of its 10 peremptory strikes to remove male jurors. Petitioner used all but one of his strikes to remove female jurors, resulting in an all-female jury. Before empanelment, petitioner objected that the State’s peremptory challenges violated the Equal Protection Clause by targeting male jurors solely based on gender, analogizing to Batson v. Kentucky’s prohibition of race-based strikes. The trial court rejected this claim, the jury found petitioner to be the father, and the court ordered child support payments.
